1. Who we are
Orca is a product of Megafauna Inc. In this policy, “Orca,” “we,” “us,” and “our” refer to the operator of the Orca website and hosted service.
This policy covers the marketing website at orca.ms, the hosted application at app.orca.ms, and related registration, application, private-beta request, and guest-chat services. If a business uses Orca to interact with its own customers, that business may also have its own privacy obligations and policies for the information it controls.
Questions about this policy or privacy requests may be sent to pod@orca.ms.
2. Information we collect
Information you provide
- Accounts: email address, password supplied during registration, verification status, account settings, and information necessary to create and manage your workspace. Passwords are handled by our Accounts service rather than stored by the marketing website.
- Orca Black applications: name, business and contact details, website, business category, team size, estimated activity, areas of interest, and anything you choose to include in your application.
- Private-beta code requests: name, email, optional organization, intended use of the source code, and optional notes.
- Product interactions: messages you submit to the guest AI demo, selected templates, and content you submit when using a hosted account or workspace.
- Communications: information you include when contacting our team or responding to our emails.
Information collected automatically
When you access our services, infrastructure and security systems may process technical information such as IP address, browser or device details, request timestamps, error reports, and activity necessary to protect and operate the service. Guest-chat rate limiting uses a keyed hash of an IP address rather than storing the raw address in its quota records.
We also store limited marketing attribution information, such as the page that brought you here, referral information, and campaign parameters when available. If you submit a form, some of that information may be included with your request.
3. How we use information
We use the information described above to:
- Create and secure accounts, confirm email addresses, manage sessions, and provision Orca workspaces.
- Provide the features you request, including guest chat and AI-assisted product functions.
- Review applications and private-beta code-access requests, and contact applicants about those requests.
- Respond to questions, support users, send service-related notices, and communicate important policy or security changes.
- Maintain service reliability, detect misuse, enforce usage limits, troubleshoot issues, and protect the infrastructure.
- Understand how visitors reach the website and improve the product and conversion experience.
- Comply with applicable legal obligations and enforce our Terms of Service.
Submitting an application or source-code request does not automatically create a user account or subscribe you to unrelated marketing messages.
4. AI chat and demos
When you send a message to Orca's guest chat, your message, relevant recent conversation context, and selected business template are sent through our hosted server to the Megafauna AI Gateway and its underlying AI inference provider to generate a response. Avoid entering passwords, financial details, medical information, or other sensitive personal data in the public demo.
The marketing site may keep a draft conversation in your browser's session storage so you can continue or move into signup. Separately, our backend keeps usage counters and short-lived security information to limit automated or excessive inference requests. Processing and retention by underlying AI and infrastructure providers may be governed by their service terms and our provider arrangements.
Guest-chat responses are generated by AI. They may be inaccurate and should not be treated as a confirmed booking, quote, payment, or professional advice.
7. Retention and security
We retain information for as long as reasonably necessary to provide the services and handle requests, manage accounts and applications, protect our systems, resolve disputes, or meet legal obligations. Different categories of information may have different retention periods. A pending application or private-beta request may remain on file until it is reviewed or otherwise no longer needed.
We use technical and organizational measures intended to reduce unauthorized access, including restricted server-side credentials, access controls, and secure session handling. No internet-connected service can guarantee absolute security.
8. Your choices and rights
Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, or to object to or limit certain processing. You may also withdraw consent where consent is the basis for processing, subject to applicable limits.
For an account, application, private-beta request, or other personal-information question, email pod@orca.ms. Please specify your request and the email address you used. We may need to verify your identity before disclosing or changing account information, and some records may need to be retained for legal or security reasons.
You can also remove marketing-site drafts and preferences by clearing your browser's local and session storage.
9. International visitors
Orca and its service providers may process or store information outside your country, including in the United States. Privacy rules and protections can differ by location. Where required, we will use appropriate measures for cross-border transfers.
10. Children's privacy
Orca's hosted account registration is intended for adults aged 18 or older, and the service is not directed to children. If you believe a child has provided personal information through Orca, contact us so we can review the situation.
11. Changes and contact
We may update this policy as the product, service providers, or applicable requirements change. We will post the revised policy here and update the date above, and provide additional notice when required.
For privacy questions and requests, contact pod@orca.ms. You can also review our Terms of Service.
